LIFETIME WORKMANSHIP WARRANTY

1. Warranty Coverage

AAA Solid Foundation Ltd. (“Contractor”) warrants that foundation repair work performed under the Agreement, including structural bracing and internal water management systems (the “Work”), will be free from defects in workmanship for the lifetime of the structure on which the Work was performed (the “Property”).

This warranty applies only to defects arising from Contractor’s workmanship within the original scope of Work. It does not extend to materials except as provided under applicable manufacturer warranties.

2. Term, Transferability & Corporate Continuity

This warranty remains in effect for the lifetime of the Property and is transferable to subsequent owners within 45 days of sale, provided required homeowner maintenance has been performed, and the new owner agrees to continue such maintenance. An inspection may be required.

This warranty is issued solely by the Contractor named in the Agreement and is contingent upon its continued legal existence. If the Contractor dissolves, ceases operations, or declares bankruptcy, the warranty is void. In the event of a business sale, the warranty continues only if the purchasing entity expressly assumes the warranty obligations in writing.

3. Sole Remedy

If a valid claim is approved, Contractor will, at its sole discretion, repair or correct defective workmanship at no cost to the Property owner. Replacement materials may be substituted with materials of equal value if originals are unavailable.

This repair is the sole and exclusive remedy. Contractor shall not be liable for incidental, indirect, consequential, or special damages, including loss of use, loss of income, diminution of property value, or damage to finished surfaces, landscaping, utilities, or personal property.

4. Exclusions

This warranty does not cover:

  • Sump Pumps & Sump Pump Check Valves’ (see Manufacturer’s Warranties below)
  • Natural disasters or Acts of God (fire, flood, earthquake, tornado, extreme weather)
  • Soil movement, settlement, hydrostatic pressure, or environmental conditions beyond Contractor’s control
  • Structural alterations, additions, excavation, grading changes, plumbing modifications, or landscaping changes after completion
  • Work modified or repaired by others without written approval
  • Improper maintenance, neglect, misuse, or drainage issues
  • Pre-existing damage or conditions in the original scope of work but declined by the Homeowner
  • Cosmetic issues unrelated to structural performance
  • Routine maintenance responsibilities

7. Manufacturer’s Warranties

Certain installed products (including sump pumps, sump pump check valves) may carry manufacturer warranties.

Contractor’s workmanship warranty does not extend to product defects, material failure, or manufacturer limitations.

8. Homeowner Maintenance Requirement

To maintain warranty validity, the homeowner must follow provided maintenance guidelines, including;

  • Maintain your Home and Property
  • Prevent water infiltration by ensuring eavestroughs are not obstructed or damaged
  • Ensure driveways, patios and sidewalks slope away from the foundation
  • Prevent low spots in the yard, prevent water from pooling around the foundation
  • Maintain caulking around foundation windows and doors
  • Ensure proper, annual, sump pump testing,
  • Maintaining eavestroughs and downspouts,
  • Snow removal near the foundation
  • Notify Us As Soon As Possible
    • Contact us in writing (email or letter) with a clear description of any issues Include any photos or videos
    • Record dates when issues were first noticed
    • Provide access for inspections and/or repairs
      Avoid Unauthorized Repairs
    • Do not attempt to fix any issues yourself or hire another contractor before contacting us.
    • If we preformed Internal Water Management on your home, (internal weeping tile, sump pits, etc.), prevent damage to this work when refinishing the basement.

Failure to maintain the Property may void the warranty.

9. Incidental Property Damage & Pre-Existing Conditions

Foundation repair may involve inherent risks of incidental property damage (e.g., landscaping, driveways, decks, utilities). Contractor will take reasonable precautions and document conditions before and after work; however, Contractor is not responsible for incidental or pre-existing damage. The Property owner is responsible for restoration and related costs.

10. Claim Procedure

Written notice of any claim must be submitted within 45 days of discovery (or when reasonably discoverable) and must include the original invoice and description of the alleged defect. Contractor must be given reasonable access to inspect and perform repairs. Failure to provide notice or access may void the warranty.

11. Disclaimer

This warranty applies solely to workmanship. All other express or implied warranties, including merchantability or fitness for a particular purpose, are disclaimed to the fullest extent permitted by law. Oral statements do not modify this warranty.

This warranty remains valid only while AAA Solid Foundation Ltd. remains an active legal entity.
In the event the company ceases operations or dissolves,
the warranty terminates. In the event of a sale, warranty coverage continues only if formally assumed in writing by the purchasing entity.
